Commission TOS
SECTION I. IMAGE COPYRIGHT1. I, SlushySnail (the artist), retain full and exclusive rights to the original artwork. The client/commissioner may NOT claim it as their own or use it for anything other than personal use.
2. The client has permission to repost the artwork wherever they would like, as long as proper credit is given to the artist and the watermark/signature remains intact and unaltered.
3. Prohibited Actions
• The client cannot alter the artwork in any way without asking for permission beforehand, with the exception of cropping/resizing the artwork for an icon or other personal use.
• The client cannot heavily reference or copy the artwork UNLESS credit is given to the artist for the original.
• The client may not claim the artwork as their own.
• The artwork may NOT be monetized. If the client wishes to sell the artwork in any way, shape or form, compensation is required and must be discussed. The client, however, is free to have products (ie. shirts or stickers) made for PERSONAL use! As long as said product is not sold.
• The artwork may NOT be used for AI generators or NFTs.
4. The commissioned artwork may be added to my professional portfolio with or without description.
5. If the above terms are broken, you will be privately blacklisted from commissioning again.SECTION II. PAYMENT INFORMATION1. Payment is expected at the beginning of the process and is required for the commission to be considered ordered and for the artist to begin working.
2. Payment (USD $) is through Ko-fi or PayPal (the client must select "Sending to a friend" when paying or PayPal will take a cut and the artist will not receive the full payment to begin the artwork).
3. The artist's commission prices are for character illustrations. If you would like something else drawn, the artist may feel comfortable drawing it and different prices can be discussed.
4. Props/items may cost a bit extra and might have to be discussed with the artist.
5. It is the commissioner's responsibility to tell the artist when the payment has been sent. Once this is confirmed, the art process will begin after.Refund Policy
1. If the commission is cancelled (by the artist or the commissioner) before the work has started, then the client will receive a full refund.
2. If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. No refund may be given once the artist is near completed with the line work process (also up to the artist's discretion).
2. These rough estimates of the amount refunded may change depending on the complexity of the commission and/or how many characters are included in the artwork.
• Sketch completed: 85%
• Revised Sketch given to the client (if the client asked for alteration): 50%
• Line work early in progress: 30%
• No refunds will be given for completed or nearly completed commissions.
3. The artist reserves the right to cancel a commission at any time, for any reason, and without explanation. If the artist cancels the commission at any time, a full refund will be given.SECTION III. CONTACT AND COMMUNICATION1. Discussion of commissions can be conducted via Instagram, Twitter, or Ko-fi (@slushysnail).
2. Visual Reference Guidelines
• The client must provide at least one clear and concise visual reference; please supplement the visual reference with any important information the artist may need to know in order to correctly draw what is being commissioned.
• If the client provides a link to a gallery of the commissioned character’s artwork (ie. a Toyhouse page), it cannot be guaranteed that the design will be done with 100% accuracy. Design interpretations, lighting, and art styles may be inconsistent between images and lessen the ability to accurately draw the character.SECTION IV. WILL/WON'T DRAW1. Below is a general guideline for what the artist will or will not draw. Please keep the artist's personal art style in mind when ordering; The client cannot request the artist to match another artist's or company's art style (example: Disney, Pokémon, etc.)A warning symbol (⚠) indicates the things that the artist may not be fully skilled in drawing.Allowed Content

• Gore

• Characters intended to be OR appearing to be underage in any suggestive context

• Any sort of hateful content
• ⚠ Mecha (ask)The artist has the right to reject any commission request for any reason.SECTION V. WORKFLOW PROCESS1. If the client does not want the commission to be posted online, the artist must be told when the artwork is ordered.
2. The artist works best when given some artistic freedom to create an image based on the characters provided. The artist will attempt to match a scene or pose that the client has requested, but please allow and expect slight variation.
3. If there are any delays in completion of a commission, the artist will personally notify the client via the same communication method used previously in the commission process.
• Completion of most commissions are generally estimated to take no more than about 1 to 2 weeks. If for any reason the artist cannot complete a commission within 90 days of ordering, a full refund will be issued. When a lined, flat colored, or full shaded commission is ordered, there will be a sketch approval stage. The artist will send any works in progress (WIPs) to the commissioner via the same communication method used previously in the commission process. Progress will be paused until the sketch is confirmed by the client.
• If the commission type includes a sketch approval stage, any major changes or revisions must be made during this stage. This includes any significant changes to a character’s pose, body shape, or design, as well as requests to redraw parts of the image.
• After the sketch has been approved, no major edits or changes will be made. If the commissioner requests any major edits after the approved sketch, a price for the edits may be discussed. This price will differ based on the edit requested and will be up to the artist's discretion.
• If I, the artist, make any unmistakable errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.The client agrees to all the above terms when they commission artwork.Version 1.1
